The Ministry of Labour & Employment has taken initiative by using e-governance measures and legislative reforms and reducing complexity in the existing labour laws into 4 labour codes.
About Labour Law:
The Ministry of Labour & Employment has been working on to rationalize the plans of the existing Central labour laws into four Labour Codes. The four labour codes are on Wages, Industrial Relations, Social Security and Occupational Safety, and Health and Working Conditions.
Brief description of four codes are mentioned below:
Labour Code on Wages:
The Code on Wages, 2019 involves 4 existing Laws namely the Minimum Wages Act, the Payment of Wages Act, the Payment of Bonus Act and the Equal Remuneration Act. It has been permitted by the Parliament.
Labour Code on Industrial Relations:
The draft Labour Code on Industrial Relations contains the existing Laws namely the Trade Union Act, the Industrial Employment Act, the Industrial Disputes Act, 1947.
Labour Code on Social Security & Welfare:
The draft Code on Social Security includes 9 Labour Acts namely the Employees Compensation Act, the Maternity Benefit Act, the Payment of Gratuity Act, the Unorganized Workers’ Social Security Act and so on.
Labour Code on Occupational Safety, Health & Working Conditions:
The Occupational Safety, Health & Working Conditions Code, 2019 contains the 13 Labour Acts namely the Factories Act, the Plantation Labour Act, the Mines Act, the Building and Other Constructions Workers Act etc.
About the e-SHRAM Portal:
The government aims to register 38 crore unorganised workers like construction labourers, migrant workforce, street vendors and domestic workers.
- e-SHRAM Portal will help in the creation of a National Database of Unorganized Workers (NDUW).
- Awareness campaigns would be planned across the country to enable nationwide registration of workers.
- Every unorganised worker who registers on the e-SHRAM Portal will get ₹2.0 Lakh Accidental Insurance cover i.e. ₹2.0 Lakh on death or permanent disability and ₹1.0 lakh on partial disability.
How will the registration for workers happen on the e-SHRAM portal? The registration of workers on the portal will be coordinated by the Labour Ministry, state governments, trade unions and CSCs.
- The registration for the e-SHRAM portal is free of cost and workers do not have to pay any registration fees.
- For registration one has to go on the official website i.e. eshram.gov.in
- On registering for the e-SHRAM Portal, the worker will get an e-SHRAM card with a unique 12 digit Universal Account Number (UAN).
- A worker can register on the portal using Aadhaar card number and bank account details, apart from filling other necessary details like date of birth, home town, mobile number and social category.
- They will be able to access the benefits of the various social security schemes through this card anywhere anytime.
- The government of India has issued a toll-free number for the convenience of crores of workers in the country. The toll-free number is 14434.
